What do I do if I have been miss-sold to?

Many of our customers have initially come onto our website because they are trying to get out of a contract that they feel they have been miss-sold into.

Miss-selling is a common complaint, especially with regards to verbal sales. Many people think that because something was only agreed on the phone, or they feel they did not fully agree, the contract is not actually binding. This is unfortunately not true. Verbal sales are completely binding.

If you feel that you have been miss-sold a verbal contract, you can do the following:
  • Contact your supplier and request a copy of the recording. For a verbal contract to be binding, a recording has to be completed. If there is no contract, you should be able to leave the supplier and agree a contract with another supplier.
  • Listen to the recording, if it is clear that you did not agree to the contract you will be able to argue that the contract is not valid.
  • If you are still unsure, feel free to contact us for more advice.
If you never agreed to the contract in the first place, and there has been a forgery of your signature, request the contract and put in a complaint with the supplier. You will have to prove that you never signed the contract.

If an employee agreed to a contract without authorisation, it is still enforceable. Your employee represented your company at the time, and would have assured the agent that they are the person responsible for the contract. To avoid this you need to ensure that nobody in your company ever entertains telesales or agencies calling up.

If you cannot get out of the contract, or if your contract has rolled over because you have missed your ‘get out window’, unfortunately there is not much you can do about it. You can contact your supplier to try to get out, but if this does not work, find out from them when this contract expires, and what your ‘get out window’ is.
